Changes to the eBay User Agreement

I'm writing to let you know that we've completed the eBay User Agreement revisions, implementing many of the programs recently announced. Please review Stephanie's seller Update announced April 14, 2009. This agreement is effective immediately for new members registering on or after today, and on June 8, 2009, for current members.

The biggest change to the agreement is the addition of a new policy -- eBay Purchase Protection -- borrowed almost directly from the existing PayPal Buyer Protection policy. In essence, eBay is now going to run the purchase protection program instead of requiring buyers to go to PayPal. We've added legal language describing the parameters of the program and incorporating the new policy into the agreement.

As with earlier updates to the User Agreement, we've made other minor changes here and there. These changes are part of a continuing effort to keep the User Agreement up-to-date with our product and service offerings and industry legal standards. You'll see references to "eBay site, services and tools" where the old agreement simply read "eBay site". The changes reflect the many new ways you can access eBay functionality through other websites, wireless devices, and tools. We've also highlighted a few sections of the agreement, based on our interpretation of a few state regulations.

I would look for answers to questions about the new eBay Purchase Protection policy in the Update.

You don't need to take any further action to accept the new User Agreement. If you don't wish to accept the new User Agreement, please refer to this Help page for instructions on how to close your account. We hope you find that these changes make the eBay site, services, and tools more useful for you.

We're writing with some exciting news about eBay fees. Starting June 16:

Every 30 days, your first 5 Auction-style listings will have NO Insertion Fees when you list with eBay's Sell Your Item form or Simple listing form--regardless of your start price.

The first 5 listings with no Insertion Fees will have a Final Value Fee of 8.75% of the sales price or $20, whichever is lower. Additional items sold during the same 30-day period will have the same Insertion Fees and Final Value Fees as they do today.

If you are currently using an eBay tool or third-party listing solution, you can either list your first 5 Auction-style listings with the new pricing structure through eBay's Sell Your Item form or Simple listing form or continue with your current practices at the current pricing-whichever option works best for you.

This change is part of our continued effort to lower the upfront costs of selling on eBay. The 5 listings with no Insertion Fees are especially helpful for sellers who may not sell in high volume, but offer unique and hard-to-find inventory buyers expect to find on eBay.
