Well technically that was a valid account that was stolen, so from ebay perspective it was not the fault of the account name (seller). There's actually no way of really knowing the identity of the scammer, unless of course you sent them a check for your "purchase", in which case I think it would be made out to "cash" and go to an anonymous PO box, probably end up in Russia or Lithuania. Could be the same people behind it, as the Zombie Berliner. I think ebay needs a better boilerplate statement to cover this, but the fact remains it was not the fault of the original account holder, except they got phished.

I think what Ebay means is it's not the real owner of the highjacked account that is at fault. This is just an automated response from Ebay so it is not quite correct for this situation.
