YouTube :pig: seems to allow itself to be fertile ground for those copyright scam lawyers :pig:. I wonder if uploaders to other media websites such as http://www.archive.org are having these problems?

Four other claims by other entities were withdrawn after my dispute.

It appears in that in addition to copyright owner, Harry Fox agency is judge and jury in the matter as there's nothing more I can do on youTube. No explanation given re. why they think they own the copyright... :x
Delete it and repost it with an unequivocal statement that the composition is PUBLIC DOMAIN. If you get another fake claim from them, let them know that you KNOW they are acting fraudulently, and are liable to legal action. Rinse and repeat.

Just let them know you are NOT going to be a pushover.

The above is a quote from the "Most spooky recordings" thread http://forum.talkingmachine.info/viewto ... f=3&t=9608. I like that song, it's really funny. What's not so funny is the "Rights & Access" info:

This recording is protected by state copyright laws in the United States. The Library of Congress has obtained a license from rights holders to offer it as streamed audio only. Downloading is not permitted. The authorization of rights holders of the recording is required in order to obtain a copy of the recording. Contact [email protected] for more information.

Credits

Source of original recording: Recorded Sound Section, Library of Congress. Inclusion of the recording in the National Jukebox, courtesy of Sony Music Entertainment.

So again Sony has/claims rights to a recording from 1915. If the Library of Congress accepts these claims, maybe Sony's YouTube claims are correct as well? At least they allow the inclusion in the National Jukebox.

Sony owns the old Victor stuff, and you could say they 'gifted' them by special arrangement for the LOC site.

A scholarly article by Tim Brooks about the sorry state of sound recording copyright in the US:
