Another Victor Junior Question

If Eldridge Johnson was blocked from using the word "gramophone" in the early court cases involving his formation of Victor Talking Machine, why as late as 1906 did he use the word "gramophone" in both the advertising and the machine label for the Victor Junior? I think the Junior was the only American Victor (post court cases) to be called a gramophone.
