BUYER BEWARE OF THIS EBAY LISTING

Post by downsouth »

http://www.ebay.com/itm/271794468730

This horn is listed on EBay now for the second time. It was sold recently with a Buy It Now price just under $100. (Not my purchase), which he did not honor and took negative feedback because of this. It's now listed again with a marginally reasonable opening bid but checkout that shipping charge. Just over $500! I questioned the seller as to why he was listing it again and now with such a high shipping charge. Thinking that it must be a mistake. He basically told me not to bid on it and to mind my own. Why are folks like this allowed to sell on Ebay with this kind of behavior?

I would imagine because Ebay charges a fee on every item that sells. If the fee is 10% and this item sells for $600, Ebay makes $60.

Maybe the person who is the winning bidder (if there is one) decides not to pay just out of spite, and let the seller know in a personal message why. Just my opinion.

He has actually refused to sell two different items that were paid for. He refunded both and took negative feedback...?

I noticed that also. So........ does he really want to sell or not. I personally think not, so why waste someones time? I've had folks have sellers remorse in the past knowing that they had screwed up and not have a care in the world just that they were keeping their item and there was nothing I could do about it. I know a person that bought a Vic V several years ago on EBay with a VERY low Buy It Now price only to be told he wasn't going to receive it. The seller was many states away, but once he received a letter from the buyers lawyer, he reluctantly handed it over. In the case with this horn, I feel sorry for the guy that got it for less that $100 only to have his money refunded.

I was the buyer in the original listing for $100 which the seller cancelled. There was no communication other than the cancellation and refund notices from ebay and paypal. It is a very nice looking horn, and needless to say I was pretty excited...followed by disappointment. It says a lot about the seller to know they cancelled 2 purchases back to back in an attempt to realize more $ rather than honor the sales.

A complaint to eBay is surely warranted (whether that proves futile is another matter). The seller is in breach of contract unless there was a compelling reason to withdraw/cancel the sale.

David, sorry that you didn't get the horn that you bid on and won. I hope you contacted ebay and filed a complaint, TWICE. The first time when your winning bid was not honored, and second when the seller relisted the item at a higher price. Ebay has rules that does not allow sellers to do this. They can actually remove the item the seller has relisted for sale. I had a very similar situation and ebay got the seller to honor the first listing.

David, I hate this happened to you. I know that sometimes getting EBay to act on situations such as this is like jumping through hoops so to speak, but in this case it is definitely warranted. This is the initial response I received when I questioned it being listed a second time and his exorbitant shipping costs. "dont bid on it then...last one sold for over 1000". His second response was very crass and arrogant as I could tell my questioning his actions were irritating him. I think several of us board members should inundate him with questions and maybe he would get the message of his wrong doing.

I doubt it. I have encountered some very shameless people out there. Life is too short to fuss with those types - just move on.

This is one of the seller's explanations, in answer to my query as to whether this horn is really for sale:

"Dear xxxxxx

it was consigned and the seller did not deliver us the horn. A week later he gave us the horn now we have it......and also informed us the last one sold for about 1000, thus the auction.

good luck"

Doesn't really give one much confidence.
